1.1 The offer and sale of products on our website (“www.bianchienardi1946.it”) are governed by these General Terms and Conditions of Sale.
1.2 The Seller offers for sale on bianchienardi1946.it products of the brand Bianchi e Nardi 1946 and conducts electronic commerce exclusively for customers categorised as Consumers. The term “Consumer” refers to any individual who concludes a legal transaction for any purpose not related to than their commercial, business or professional activities. It is expressly forbidden to resell, rent or assign for any commercial or professional purpose products purchased from this Website.
1.3 These General Terms and Conditions are published on the Website so that the Customer can read them, as well as store and reproduce them. It is understood that placing a purchase order on the website bianchienardi1946.it implies complete and absolute knowledge of these General Terms and Conditions of Sale, of which this preamble is an integral and substantive part, as well as full acceptance thereof.
2. Purchase Orders
2.1 Orders may only be placed by persons of legal age and who are not under legal disability.
2.2 In order to conclude the purchase agreement of one or more products on bianchienardi1946.it, the Customer must fill out the order form in an electronic format and send it to the Seller electronically, following the applicable instructions. In the order form, which is displayed immediately before the conclusion of the purchase agreement, the Seller shall provide summary information about the main features of each product ordered, about their price and the shipping costs. The agreement is concluded when the Seller electronically accepts the order form, after verifying the accuracy of the data corresponding to the order.
2.3 When submitting the order form, the Customer will be advised that this submission implies the obligation to pay the indicated price. Before proceeding with the submission of the order form, they will also be required to identify and correct any errors that might have occurred in relation to the data entered.
2.4 Products will be delivered to the address indicated by the Customer only after the correct registration of the payment corresponding to the order. The Seller fulfils the order of the products within 30 days from the date on which the agreement was concluded, upon receipt of the purchase price, unless they notify the non-acceptance of the order within the same deadline under the terms stipulated in article 4.4.
2.5 With the electronic transmission of the order form, the Customer accepts unconditionally and undertakes to observe, in relation with the Seller, these General Terms and Conditions of Sales.
3.1 On bianchienardi1946.it it is also possible to order items that are not available at the time of order (“Pre-Ordered Products”). The same order can include both Pre-Ordered Products and available products.
3.2 The Seller only manufactures Pre-Order Products after receiving payment of the corresponding price from the customer.
3.3 By way of derogation from paragraph 7 of these General Terms and Conditions of Sale, Pre-Ordered Products may be delivered 12 to 16 weeks from the day of concluding the corresponding order. Delivery times are in any case approximate. However, the Seller shall send by email a confirmation of shipping as soon as the products are available. If, within the same order, more Pre-Ordered Products with different delivery dates are purchased, they will all be shipped in a single package at the latest estimated delivery date.
3.4 If at the time of delivery of the Pre-Order Products their price is higher than the price fixed when the order was placed, the Seller shall not be required to pay any difference. Similarly, if at the time of delivery of the Pre-Order Products their price is lower than the price fixed when the order was placed, the Seller shall not be required to deduct any difference.
3.5 If, within the same order, the Customer has purchased both available products and Pre-Ordered Products (so-called mixed orders), the Seller will ship the available products in accordance with the standard times provided for in paragraph 7 of these General Terms and Conditions of Sale, while the Pre-Ordered Products will be shipped once they become available in accordance with paragraph 3.3 above.
4. Conclusion of the Order
4.1 The purchase process ends when the Customer confirms the order. Upon confirmation, the order is sent directly to BIANCHI E NARDI.
4.2 The Customer may amend the order before its conclusion or stop the ordering procedure, abandoning the website without placing an order.
4.3 The order placed by the Customer is deemed binding for BIANCHI E NARDI only when the entire purchase procedure has been completed correctly and in accordance with the terms, without any errors being highlighted by the Website. The agreement between the Seller and the Customer must therefore be considered concluded when the Customer receives confirmation from the Seller via the e-mail address specified that the purchase order sent in reference to the purchase procedure has been successful. Together with this confirmation the Customer receives a complete summary of the purchase made.
4.4 Before the Seller sends the notification of conclusion of the agreement, they reserve the right to consider accepting the orders received and to no accept purchase orders if they are incomplete or incorrect or if the products are unavailable. In these instances, Bianchi e Nardi shall proceed to inform the Customer that the agreement has not been concluded and that the order will not be fulfilled and specify the reasons. Such communication shall be made within 30 days of the day following the date on which the Customer placed the order with the Seller, who shall reimburse any sums already paid by the Customer in relation to the order.
4.5 After the conclusion of the agreement, the Customer will receive via the email address specified written confirmation of the order placed, containing information regarding the number and date of purchase, the product ordered, its price and the amount paid.
4.6 Solely for orders of ready-to-order Products, the Customer may cancel the order by calling BIANCHI E NARDI Customer Service, but only until the products in the order are ready for shipping.
5. Conditions for Payment
5.1 Payment on the part of the Customer can be made through one of the payment methods indicated in the order form.
5.2 In the case of payment by credit card, the purchase price for the products, as indicated on the order form, will be debited to the Customer’s credit card when the order is prepared for shipping.
5.3 For payment purposes, the Customer shall confirm through the bianchienardi1946.it website that they are the holder of the specified credit card and that the name specified on said card is theirs; therefore, they communicate the number, expiration date, and security code specified on their credit card. The payment transaction is processed on a secure page that utilises SSL (Secure Socket Layer) certificates, a system that guarantees maximum security for online transactions. 5.6 In the case of payment through PayPal, the total amount due will be charged to the Customer by PayPal at the conclusion of the online agreement. In case of termination of the purchase agreement and in any other case of reimbursement, for any amount, the amount reimbursed shall be credited to the PayPal account of the Customer. The crediting periods of the payment instrument linked to said account depend solely on PayPal and the banking system. Once the credit order in favour of said account has been arranged, the Seller shall not be held liable for any delays or omissions in the crediting of the amount reimbursed to the Customer, and in order to challenge these, the Customer is required to contact PayPal directly.
6. Guarantee and Product Price Listings
6.1 Bianchienardi1946.it exclusively lists products with the trademark Bianchi and Nardi 1946 which can be purchased directly from the Seller at the fashion house.
6.2 The Seller does not sell used or faulty products or products of inferior quality to the corresponding standards available on the market.
6.3 The essential features of the products are presented in each product description on bianchienardi1946.it. The images and colours of the products offered for sale on bianchienardi1946.it may not match the actual ones due to the Internet browser and monitor used.
6.4 Product prices are understood to include all taxes and duties, as well as ordinary shipping charges, unless otherwise indicated on the website bianchienardi1946.it or on the order screen. The prices on the Bianchi e Nardi 1946 website are displayed in EURO and include VAT.
6.5 Purchase orders from Countries other than the ones displayed on the splash page are not accepted by the Seller.
7.1 In any case, the Customer may call or send an e-mail to Customer Service for any information regarding delivery.
7.2 Subject to the exceptions provided for in the following paragraphs, the products are delivered exclusively at the address indicated by the Customer in any of the following territories: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, United Kingdom.
7.3 It is not possible to indicate a shipping address (or otherwise request the delivery) outside these territories.
7.4 The Customer may in any case have the right to request that the products they ordered be delivered to an individual of their choice, whose residence or domicile is within these territories. It is understood that no delivery can be made to mailboxes, to addresses of carriers or to post restante mail.
7.5 The products are delivered at the address indicated by the Customer only after the correct registration of the payment corresponding to the order. The Seller fulfils the order of the products within maximum 10 business days from the date on which the agreement was concluded, upon receipt of the purchase price, unless they notify the non-acceptance of the order within the same deadline under the terms stipulated in article 4.4 above.
For products requiring special Customs Documentation (Cites), the delivery will take place within 45 days of the acceptance of the corresponding order.
7.6 Regarding deliveries requested in countries outside the European Union, any import customs duties will be borne by the recipient. Customs duties and potential taxes vary depending on the country of destination and are applied upon the arrival of the goods in the respective country. Therefore you should contact the customs authorities in your country in advance to check the costs and potential import limitations.
7.7 Charges connected to the delivery arrangements referred to in article 7 shall be included in the sale price.
All shipping charges, including additional charges, if charged to the Customer are specifically indicated in the order form at the time of purchase from the website. Only the additional charges are non-refundable, even when the Customer cancels or replaces the product.
7.8 The Customer may contact Customer Service to agree on a different delivery date.
8.1 The liability of the Seller for any defective material shall be governed by the applicable law.
8.2 The Customer has no right to raise any claim for defective products when the defect is a consequence of an alteration performed by the Customer or if they have exchanged the good through a third party, unless the Customer can prove that the defect existed at the time of delivery.
8.3 In case of cancellation of the order, no amount shall be debited from the Customer’s credit card. In the event that a debit has already been made from the credit card, the Customer shall be reimbursed immediately. In the same manner, if the payment is made through PayPal where the amount is charged at time of placing the order the Customer shall be promptly reimbursed in case of an order cancellation.
9. Returns and Reimbursements – Cancellation
9.1 The Customer can exercise their right of cancellation using the procedure described below.
The right of cancellation must be exercised by the Customer within 14 (fourteen) days from the date on which the Products are delivered to the Customer or to a third party.
9.2 In order to exercise the right of cancellation, Customers must contact Customer Service or follow the on-line procedure to obtain a return code. Upon receipt of the return code, the Customer shall make an appointment of the return by contacting UPS and shall affix the pre-printed return label on the package.
In order for the delivery to be accepted by BIANCHI E NARDI, the products must be returned within 14 days from the date on which the Customer informed BIANCHI E NARDI that they wish to cancel the purchase by sending the return form via the online procedure or by explicitly notifying the Customer Service of the cancellation in order to obtain the return code, and is subject to the following conditions:
i. The products must be returned in full, with all the original packaging (boxes, accessories, tags, protections, leaflets etc.);
ii. The products must be accompanied by the purchase receipt;
iii. The products returned by the Customer must not be damaged, used, worn, washed, however they may show signs of having been manipulated and inspected to determine their nature and characteristics.
iv. The identification tag must still be attached to the products;
v. Damaged goods subject to be returned must be rendered as having been received by the Customer, without any attempt to modify, manipulate or repair them.
The Seller also reserves the right to claim compensation for any damages that may be attributed to the Customer’s intentional or negligent behaviour when returning the products. The Seller is not liable for any loss or theft of the products delivered, and they cannot be held liable in such events, as well as in the case of a return to an incorrect address or delays in delivery of the products, thus being understood that the Customer assumes all the risks of delivery.
9.3 In addition, the Customer shall be liable for the return of the products.
In the event of a cancellation, all payments made to the Seller in accordance with the payment method chosen for the purchase shall be reimbursed to the Customer in respect of the product for which the cancellation has been made, including the costs of delivery.
9.4 The Seller shall reimburse these payments when receiving the product delivered. The amount reimbursed shall be credited to the Customer’s account corresponding to the credit card used by them for payment or through PayPal. Such reimbursement shall not entail any cost to the Customer.
10. Product Authenticity and Intellectual Property Rights
10.1 The Seller guarantees the authenticity and high quality of all the products offered for sale on the Website.
The BIANCHIENARDI1946 brand, as well as all the figurative and non-figurative marks and, more generally, all other marks, illustrations, images and logos placed on the products, their accessories and/or packaging, irrespective of whether they are registered or not, and remain the exclusive property of the company PELLETTERIE BIANCHI E NARDI S.r.l., with their registered office in Scandicci (FI) Via delle Fonti no. 2. The full or partial reproduction, modification or use of such marks, illustrations, images and logos, irrespective of the reason and the medium, without the prior express agreement of the company PELLETTERIE BIANCHI E NARDI S.r.l. are completely forbidden. This clause does not apply to the private use of BIANCHIENARDI1946 products.
10.2 The full or partial reproduction, modification or use of designs, models or patents which are the sole property of the company PELLETTERIE BIANCHI E NARDI S.r.l. are also forbidden.
11. Force Majeure
11.1 The company PELLETTERIE BIANCHI E NARDI S.r.l. may suspend the performance of their service in the event of a fortuitous or force majeure event which could prevent or cause delays in its execution.
11.2 The Seller shall inform the Customer of the occurrence of a fortuitous or force majeure event within 7 days of its occurrence. In case the service is suspended for a period of more than 15 days, the Customer has the option of cancelling the order and thus being reimbursed for the amounts already paid.
The Customer can always get information on how BIANCHI E NARDI processes their personal data by accessing the Privacy Notice on the website.
13. Jurisdiction and Applicable Law
13.1 The jurisdiction applicable to sales agreements concluded via the bianchienardi1946.it website is that of the place of residence or domicile of the Customer. In order to settle disputes, it is possible to use the mediation procedures provided for by the Legislative Decree of 4 March 2010, no. 28. It is also possible to make use of the out-of-court settlement of disputes, including the RisolviOnline Conciliation Service provided by the Chamber of Arbitration of the Milan Chamber of Commerce.
13.2 The orders placed under these Terms and Conditions of Sales are governed by Italian law, in particular by the Italian Civil Code, by the Legislative Decree of 6 September 2005, no. 206 and the Legislative Decree of 9 April 2003, no. 70, excluding conflict rules and any rules provided for by private international law. The applicability of the Vienna Convention on the Sale of Mobile Goods of 1980 is also excluded. In the event of conflict between versions of the Terms and Conditions of Sale made available in a language other than Italian and accepted by the Customer, the meaning and interpretation of the Terms and Conditions of Sale in Italian shall prevail.
